These terms are the agreement between you and Cubyard LLC, the company that makes CurlyGirl. They cover the CurlyGirl app on iPhone and Android, this website, and the links you can share from the app. By creating an account or using CurlyGirl, you agree to them. We have tried to keep them short and plain. Our privacy policy explains what we collect and how we use it, and is part of this agreement.
1. Who can use CurlyGirl
- You need to be at least 13 years old. Where the law sets an older age for agreeing to terms like these, use CurlyGirl only with your parent or guardian's permission.
- You can add a hair profile for someone you look after, such as your child. If you do, you are telling us you are their parent or legal guardian, and you are responsible for what you add about them.
- You may not use CurlyGirl if the law where you live does not allow it.
2. Your account
You sign in with Google or Apple, so your account is only as safe as that sign-in. Keep it to yourself, and tell us at [email protected] if you think someone else has used it. You are responsible for what happens in your account. One account is for one person; add profiles for the people you look after instead of sharing a sign-in.
3. What CurlyGirl is, and what it is not
CurlyGirl helps you track your wash days, your products, and how your hair feels, and offers general hair care information along the way. Please keep these limits in mind:
- It is not medical advice. Nothing in CurlyGirl is a diagnosis or treatment. For hair loss, a scalp condition, a reaction to a product, or anything that worries you, see a dermatologist, trichologist, or another qualified professional.
- Suggestions can be wrong. Wash mix insights, product picks, heads-ups, Hair Talk answers, and product details read from photos are produced automatically, partly by AI. They can miss things or get things wrong. Use your own judgment, and check a product's label before you use it.
- Product information can change. Ingredient lists, names, sizes, and pictures come from labels, brands, and public sources, and brands change their formulas. Your avoid list only checks the ingredient list we have, so always read the label on the product in your hand, especially if you react to an ingredient.
- We are independent. We are not paid by the brands in our catalog, and showing a product is not an endorsement. Brand names and product images belong to their owners.
4. Free credits
CurlyGirl is free to use. Some features, such as adding a product from a photo and Hair Talk, use credits. You get free credits every week, and we may sometimes add bonus credits. Credits have no cash value, cannot be bought, sold, or transferred, and end when your account is deleted. We may change how many credits you get, what each feature uses, or which features use them. When your credits run out, those features rest until your free credits refresh.
5. Your content
What you add to CurlyGirl, such as your hair profiles, washes, notes, check-ins, photos, and Hair Talk chats, stays yours. You give Cubyard LLC permission to store, copy, process, and display it only as needed to run CurlyGirl for you and to keep it working and improving, as our privacy policy describes. That permission ends when you delete the content or your account, except for copies in backups that roll over on their own.
Only add photos and words you have the right to share. Please do not add photos of other people without their permission.
Shared routine links. When you make a link for a wash, anyone who has the link can see the products and technique names in that wash. You choose who you send it to, and you can turn it off any time. If you add products from someone else's link, you are adding catalog products to your own shelf; nothing of theirs is copied to your account.
6. Using CurlyGirl fairly
Please do not:
- Break the law, or use CurlyGirl to harass, threaten, or harm anyone.
- Upload anything illegal, sexual, hateful, or that you do not have the right to share.
- Try to get into accounts, data, or systems that are not yours, or test our security without our permission.
- Scrape, copy, or resell our catalog or content, or use bots to use CurlyGirl at scale.
- Get around credit limits or other limits, for example by making extra accounts.
- Interfere with how CurlyGirl works, or try to copy, change, or take apart the app, except where the law allows it.
- Use Hair Talk or other features to produce content meant to mislead or harm people.
7. Our content
The CurlyGirl app, this website, our product catalog as we have put it together, our lessons, our designs, and the CurlyGirl name and logo belong to Cubyard LLC or the people who license them to us. We give you a personal, non-exclusive, non-transferable permission to use CurlyGirl for your own hair care, under these terms. You may share a shared routine link and screenshots of your own routine.
8. Ideas and feedback
We love hearing what would make CurlyGirl better. If you send us an idea or feedback, we may use it without owing you anything.
9. The app stores
If you got CurlyGirl from the App Store, this agreement is between you and Cubyard LLC, not Apple. Apple is not responsible for CurlyGirl or its content, has no duty to provide maintenance or support for it, and is not responsible for any claim about it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone else's rights. If CurlyGirl fails to meet any warranty that applies, you can tell Apple, and Apple will refund the price you paid for the app, if any; beyond that, Apple has no warranty obligation for it. You confirm that you are not in a country under a US government embargo or named as a terrorist-supporting country, and that you are not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of CurlyGirl also has to follow the App Store's own usage rules.
If you got CurlyGirl from Google Play, Google Play's terms of service also apply to your download.
10. Changes to CurlyGirl
We keep improving CurlyGirl, so features may change, be added, or be taken away. We try to keep the app running smoothly, but we cannot promise it will always be available or free of errors, and we may pause it for maintenance.
11. Ending your account
You can stop using CurlyGirl at any time, and delete your account in the app on the Me tab under "Delete account". We may suspend or close an account that seriously or repeatedly breaks these terms, or when the law requires it. Where it is fair and safe to do so, we will tell you first and give you a chance to put things right. If we ever stop offering CurlyGirl, we will give you reasonable notice. Sections 7, 8, and 12 to 17 keep applying after your account ends.
12. Disclaimers
CurlyGirl is provided "as is" and "as available". To the fullest extent the law allows, Cubyard LLC makes no promises beyond those written in these terms, including any implied promises that CurlyGirl is fit for a particular purpose, accurate, or uninterrupted. Some places do not allow these disclaimers, so they may not all apply to you.
13. Limits on our liability
To the fullest extent the law allows, Cubyard LLC is not liable for indirect, incidental, special, or consequential losses, or for lost data or profits, arising from your use of CurlyGirl. Our total liability for any claim about CurlyGirl is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars. Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.
14. Your rights as a consumer
Nothing in these terms takes away rights you have under the consumer laws of the country where you live that cannot be changed by agreement.
15. Law and disputes
These terms are governed by the laws of the State of Louisiana and the United States, without regard to conflict of law rules. If you have a problem, please write to us first at [email protected]; most things can be sorted out quickly. If we cannot resolve it, disputes go to the state or federal courts in Louisiana. If you live outside the US, you may also bring a claim in the courts where you live, and your local consumer laws still protect you.
16. Changes to these terms
We may update these terms as CurlyGirl grows. We will post the new version here and update the date at the top. If a change materially affects you, we will tell you before it takes effect, for example in the app or by email. If you keep using CurlyGirl after a change takes effect, the new terms apply. If you do not agree with them, you can delete your account.
17. The rest
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a part right away, we can still enforce it later. You may not transfer your rights under these terms to anyone else; we may transfer ours as part of a merger or sale of our business, and these terms will still protect you.
